1. Acceptance of Orders

Welcome to Eagle Bounce. Eagle Bounce provides its products to you, subject to the following Terms and Conditions which may be updated by us from time to time without notice to you. Eagle Bounce accepts and confirms buyer's order for the items and goods described on the sales invoice. As a buyer, you agree to the terms and conditions of sale set forth herein below. No different or additional terms will be accepted unless agreed in writing and signed by Eagle Bounce personnel.

Compliance Responsibility: It is the buyer's full responsibility to check with local government on any laws and regulations related to the purchase and use of the products. Buyer agrees and fully understands that Eagle Bounce is not registered to sell products in the states of PA and NJ. Buyer agrees to obtain all required certificates and licenses before use.

2. Prices & FOB

Unless expressly stated otherwise, prices for all merchandise are F.O.B. Arlington, Texas. Prices, discounts, quotations, and specifications are subject to change without notice unless a required deposit or payment has been paid and secured.

3. Payment Terms

All charges are payable in US Dollars. Payment requirements are as follows:

• Custom Orders: Buyer must make a 60% deposit on custom-made items (custom colors, designs, or branding).
• Stock Inventory: All units are sold on a first-come, first-served basis. To guarantee availability, a minimum deposit of 25% is required.
• Final Payment: The remaining balance must be paid within 7 days after the unit is available. Each order must be paid in full prior to shipping.

4. Sales Tax (Texas)

Eagle Bounce’s prices do not include sales tax. Any present or future sales tax applicable to the sale shall be paid by the Buyer. Buyer agrees to indemnify Eagle Bounce from all taxes, penalties, or interest arising from Buyer’s failure to qualify for any tax exemption.

5. Shipping & Delivery

Risk of loss, damage, or destruction of any product is assumed by Buyer once placed in the hands of the carrier. If Buyer does not specify a preferred method, Eagle Bounce shall exercise sole discretion in selecting a method. All shipping costs, insurance, and duties are the sole responsibility of the Buyer.

Report Defects: Any manufacturer defects must be reported to the seller in writing within 7 days from the date freight is delivered.

6-7. Product Availability & Copyrights

Eagle Bounce reserves the right to discontinue models or make design changes without obligation to update previously sold products. All logos, artwork, and designs are the proprietary property of Eagle Bounce. Unauthorized reproduction constitutes copyright infringement punishable by law.

8. Return & Cancellation Policy

If Buyer cancels an order after payment processing, Eagle Bounce reserves the right to withhold initial payments to remedy production readjustment costs.

9-12. Legal, Insurance & Governing Law

Insurance: Buyer agrees to carry general liability insurance with limits of no less than $1,000,000 in connection with the use or rental of Eagle Bounce goods.

Governing Law: This transaction shall be enforced under the laws of the State of Texas. Exclusive venue for litigation shall be Tarrant County Superior Court or US District Court for Texas.

13. Limited Warranty Coverage

Eagle Bounce provides a limited repair warranty for products identified as Eagle Bounce merchandise (Receipt Required).

Voiding Warranty: Misuse, improper handling, lack of ground covers, or mildew voids the warranty. Buyer is responsible for shipping costs for warranty repairs.

14. Limitation of Liability

Under no circumstances shall Eagle Bounce be liable for any incidental, consequential, punitive, or special damages arising from the use or inability to use the goods for any purpose whatsoever.
